Terms of Service

1. Acceptance of Terms

By accessing and using the TimeShare BI platform, you fully agree to these Terms of Service. If you do not agree with any part of these terms, you should not use the platform. Continued use of the platform constitutes acceptance of any modifications made to these terms.

2. Service Description

TimeShare BI is a SaaS platform that allows users to share Power BI dashboards through secure links, with time limits, optional password protection, and specific filter application. The platform facilitates report sharing with third parties without requiring PRO Power BI accounts for viewers.

3. User Responsibility for Shared Data

The user is FULLY and EXCLUSIVELY responsible for the data they choose to share through the platform. By creating a sharing link, you declare and warrant that: (a) you have authorization to share the data contained in the report; (b) the link recipients are people you trust and know; (c) you are aware of the risks of sharing sensitive or confidential information; (d) you will not use the platform to share illegal, defamatory data, or data that violates third-party rights.

IMPORTANT: TimeShare BI is not responsible for any misuse, leakage, or unauthorized disclosure of data shared by users. It is the user's sole responsibility to ensure that link recipients are trustworthy and that the shared content is appropriate.

4. Power BI Embedding Methods

The TimeShare BI platform uses two distinct Power BI report embedding methods, depending on the availability and configuration of the user's environment. By using the platform, you declare that you understand and agree with both methods:

Embed Token

When available, the platform uses the Embed Token generated through a Premium or Embedded Power BI capacity. This method requires the user to have a dedicated capacity (Premium or Embedded) configured in their environment. The Embed Token offers greater control and security, as it is generated specifically for each viewing session and has a configurable expiration time.

AAD Token (Azure Active Directory Token)

When the user's environment does not have Premium/Embedded capacity configured, the platform uses the AAD Token (Azure Active Directory authentication token) for report embedding. This method uses the authenticated user's delegated permissions and works with Power BI PRO license or higher. The AAD Token allows users without dedicated capacity to still share their reports through the platform.

The choice between Embed Token and AAD Token is made automatically by the platform based on the availability of resources in your Power BI environment. You acknowledge and accept the embedding method used by the platform and understand the technical differences between them.

5. Plans, Payments, and Cancellations

TimeShare BI offers different subscription plans with specific features and limits. By subscribing to a paid plan, you agree to the following terms regarding plan management and billing:

Plan Upgrades

You may upgrade your subscription plan at any time. Upgrades take effect immediately, and you will have access to the new plan features right away. The billing will be adjusted proportionally for the remaining period of your current billing cycle.

Plan Downgrades

You may downgrade your subscription plan at any time. Downgrades also take effect immediately. If your current usage exceeds the limits of the new plan, you will need to adjust your usage (e.g., remove excess active links) to comply with the new plan restrictions.

Subscription Cancellation

You may cancel your subscription at any time through the 'Manage Billing' option in your account. Upon cancellation, you will retain full access to your paid plan features until the end of your current billing period. After this period expires, your account will automatically revert to the Free plan. No refunds will be provided for partial billing periods.

Free Trial Period

New subscribers to paid plans receive a 5-day free trial period. The trial is available only once per account and only for users who have never had a paid subscription. If you cancel during the trial period, you will not be charged. After the trial ends, billing begins automatically unless you cancel before the trial period expires.

Price Changes

TimeShare BI reserves the right to modify subscription plan prices at any time. All price changes will be communicated with at least 30 days advance notice via email to the address registered in your account. Current subscribers will have their new prices applied starting from the next billing cycle after the notice period. If you do not agree with the price change, you may cancel your subscription at any time before the new price takes effect.

6. Plan Limits and Downgrade Consequences

Each subscription plan has specific resource limits (active links, filters per report, email sharing, etc.). It is the user's responsibility to maintain their usage within the limits of the contracted plan.

Attention: Automatic Access Blocking

Plan Downgrade: If you downgrade to a plan with lower limits and your current usage exceeds those limits, ALL access to your shared links will be IMMEDIATELY BLOCKED until you adjust your usage to be within the limits of the new plan.

Subscription Cancellation: After cancellation, when your account is reverted to the Free plan, if you have more resources in use than the Free plan allows, all link access will be blocked until you remove the excess resources.

Payment Failure: If there is a payment failure for your subscription and your account is downgraded to the Free plan, the same access blocks will apply if you exceed the Free plan limits.

Access Blocking: When plan limits are exceeded, NO ONE will be able to access ANY of your shared links until you: (a) upgrade to a plan suitable for your current usage, or (b) remove/deactivate excess resources (active links, filters, etc.) to be within the limits of your current plan.

By downgrading, canceling, or failing to maintain payments up to date, you acknowledge and accept that it is your responsibility to ensure your usage is within the limits of the resulting plan, and that access blocking to links is automatic and immediate when limits are exceeded.

7. Limitations of Liability

TimeShare BI is not responsible for: (a) service interruptions caused by maintenance, technical failures, or problems in Power BI/Microsoft infrastructure; (b) data loss or report unavailability due to problems in the user's environment; (c) improper use of the platform by users or third parties; (d) direct, indirect, incidental, or consequential damages resulting from the use or inability to use the platform; (e) actions or omissions of third parties who received access to shared links.

8. Service Modifications

TimeShare BI reserves the right to modify, suspend, or discontinue, temporarily or permanently, the service (or any part thereof) with or without prior notice. You agree that TimeShare BI will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

9. Applicable Law and Jurisdiction

These Terms of Service are governed by the laws of the Federative Republic of Brazil. The jurisdiction of the District of Rio do Sul, State of Santa Catarina, Brazil, is elected to settle any disputes arising from these terms, with express waiver of any other, however privileged it may be.

10. General Provisions

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect. TimeShare BI's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and TimeShare BI regarding the use of the platform.
